Twin Falls Schools, Transgender Bathrooms--and the Real Problem

A friend of mine sent me this policy statement from the Twin Falls School District: Policy #3281 adopted on 10/12/2015, with the title of "Gender Identity and Sexual Orientation." You may download this document HERE. It states that:

Students will be allowed to use the restroom and locker room that corresponds to the gender identity they consistently assert at school. No student will be required to use facilities that conflict with his or her gender identity consistently asserted at school. A transgender student or any other student who has a need or desire for increased privacy may be given the option of using a separate or private restroom or changing area, such as a single stall restroom, if such is available. No student shall, on account of their transgender status, be required to use such separate facilities.

It is interesting to note that this policy statement claims Title IX as a legal basis. Title IX states that:

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

The purpose for Title IX, according to the Department of Education, is to enforce violations pertaining to sex-based discrimination.

Educational programs and activities that receive ED funds must operate in a nondiscriminatory manner. Some key issue areas in which recipients have Title IX obligations are: recruitment, admissions, and counseling; financial assistance; athletics; sex-based harassment; treatment of pregnant and parenting students; discipline; single-sex education; and employment. Also, a recipient may not retaliate against any person for opposing an unlawful educational practice or policy, or made charges, testified or participated in any complaint action under Title IX. For a recipient to retaliate in any way is considered a violation of Title IX. The ED Title IX regulations (Volume 34, Code of Federal Regulations, Part 106) provide additional information about the forms of discrimination prohibited by Title IX. President Obama, in his usual dictatorial manner to use his power for social engineering, extended the meaning of sexual discrimination to include the rights of transgender students to use the bathroom/locker room of their choice--OR ELSE! Or else what? Any school not complying will be denied Title IX funding.

Note also this isn't just about bathrooms. If you read the TF School Board's policy statement closely you will see that transgender students will also be allowed to participate in athletics according to how they identify themselves sexually. Under "School Activities" the policy states:

The District will provide all students the opportunity to participate in any activities segregated by gender in a manner that is consistent with their gender identity consistently asserted at school

.

However, activities under the direction of the Idaho High School Activities Association (IHSAA) shall be subject to IHSAA rules and regulations).

The IHSAA Rules say:

Transgender Student Participation

A transgender student, defined as a student whose gender identity differs from the student’s assigned birth gender, shall be eligible to participate in interscholastic athletics that is consistent with the student’s gender identity, under the following conditions:

a. A female-to-male transgender student athlete who is taking a medically prescribed hormone treatment under a physicians care for the purposes of gender transition may participate only on a boys team.

b. A male-to-female transgender student athlete who is not taking hormone treatment related to gender transition may participate only on a boys team.

c. A male-to-female transgender student athlete who is taking medically prescribed hormone treatment under a physicians care for the purposes of gender transition may participate on a boys team at any time, but must complete one year of hormone treatment related to the gender transition before competing on a girls team.

d. Process: A student athlete who has completed, plans to initiate, or is in the process of taking hormones under a physician’s care as part of a gender transition shall submit the request to participate on a sports team to the administration of the student’s school and to the IHSAA. The request shall include a letter from the student’s physician documenting the student’s intention to transition or the student’s transition status if the process has already been initiated. This letter shall identify the prescribed hormonal treatment for the student’s gender transition and the date the hormone treatment was initiated. The Executive Director shall make a determination whether the student is eligible to compete under the above criteria.

So what this means is that a boy may play volleyball on the girl's team. This hardly seems fair due to the advantage of a male's physical size and power whether he is taking hormones or not. That transgender male may be the ace in the hole of one team over another! Where's the "equality" in that?

But for me the real problem here is not really who uses what bathrooms or play on which team. I believe the greater issue at stake is the forced social engineering to change America from a nation of traditional Judeo-Christian values to a secular orientation that absolutely ignores the laws of nature. Furthermore, the idea of "normalcy" is so skewered it can in no way square with reality. The media, the courts, and now even the executive branch have shifted America's perception of what is normal to include obvious abnormal behavior and standards. Once reality becomes redefined by artificial means of mass propaganda and laws that bear no resemblance to the intent of the Constitution, anything can and will go. Don't believe me? check out Canada's new law which allows for bestiality! If the only standard we can go by is a merely human construct then the very idea of morality means nothing. Society will continue to descend into an existential morass of darkness and confusion.

Classical liberalism, a la John Locke and Thomas Jefferson, was founded upon the idea of natural law which included the right to life, liberty and the pursuit of happiness. For classical liberals nature's laws are based on the God of nature, thus law in essence derives from a divine source. Natural law itself was reflected by the common law operational in England since the times of the Anglo-Saxon tribes. This common law became the basis of English and American jurisprudence. The relationship between natural law and liberty with its focus on individual rights, not derived by government but by God, was left unchallenged until the formal concept of collectivism rooted in the work of Karl Marx and his disciples such a Vladimir Lenin took root not only in Russia and Europe, but in the United States as well with the rise of the progressives.

Collectivism cannot work without individual rights becoming subjugated to the "greater good" of society. That the basic unit of society is the individual and family is besides the point for collectivists. Therefore, the concept of natural law (rooted in divine law) must be shifted to a man-made, relativistic law, and of course the family must be weakened.and even destroyed. Once this happens individuals become mere components of society with no loyalties outside the reigning ideology of the state.

"Bourgeois morality" is a threat if your goal is a political revolution which cannot be achieved without a social revolution preceding it. Why the social revolution first? Because it unmoors the masses from traditional thinking and values. Everything from the past must be questioned and seen as irrelevant to "our times." Since the Constitution was established on the classical liberal thought of the Founding Fathers, then the ideals of classical liberalism must be suppressed and transformed into the artificial construct of the progressivist (socialist!) agenda..

Certainly the idea of individual rights will be lauded by the social engineering schemers. After all, isn't that what this whole LGBT+ rights thing is all about? NO! What was considered--rightly--as sexual deviancy even a generation ago is now considered a paramount principal of equality and a civil right. So paramount in fact, that the individual rights of others, including free speech, freedom of religion, and even the rights of business owners to decide how to conduct their own business affairs MUST be trumped by the social justice warriors in order to force the new moral order on intolerant Christians and other traditional Americans (though they seem eager to give a pass to Muslims who slay homosexuals and treat women as chattel).

What we are witnessing, even here in li'l ol' Twin Falls, is a sea-change of not only societal mores, but the overthrow of the basis of Western Civilization until about 1900 A.D.. We are seeing the fruit of the labor of the likes of Adam Weishaupt, Karl Marx, Woodrow Wilson, Franklin Delano Roosevelt --and Barack Hussein Obama. These, and so many more like them, are all globalists with the vision of a New World Order ruled by a Dictatorship of the Proletariat: the so-called elites, the central bankers, the mega-corporations, the United Nations, and of course the usual sociopathic politicians.

As a libertarian and constitutionalist I will in no way endorse the mistreatment of any minority group including gender-confused kids and adults. I strongly believe in the self-ownership of each person, will fight for their individual and constitutional rights, and respect their God-given right to freewill even if I believe they are wrong. But I also insist on my right to disagree with bad "lifestyle" choices. I will not exchange my Christian concepts of morality for a new cultural standard that does not align itself to God, natural law, or reality (no, I don't believe chickens can be dogs or cats can be mice either!). Nor will I tolerate my civil liberties being violated by the the so-called "rights" of others. One person's rights end where another person's begin.

The transgender bathroom issue is just the precipice of the iceberg. When we begin analyzing the deeper ramifications we start to see a whole slew of freedom-denying agendas underneath. I have discussed just one aspect, but more is involved such as government overreach, executive power, activism on the part of the courts, the constitutionality of not only Title IX but even for a Department of Education, the underlying scheme to subvert American morality and the family, even the very sovereignty of the United States when you consider the U.N.'s role in this social quagmire.

And lastly, on a personal note, I really don't want men sharing space with my teen-age daughters in the bathroom. Jeez, talk about threatening their "safe space!"
